OSC Lives

posted on Jan 23, 09 09:30AM

The Ontario Securities Commission has instructed HudBay to allow its shareholders to vote on the proposed acquisition of Lundin Mining. The commission appears to have come alive when shaken by the clout of the Ontario Teacher’s Pension Plan, a significant HudBay shareholder. It is very interesting that the OSC has been silent in the case of Callinan's request for full disclosure by HudBay in regards to the HudBay's alleged lack of disclosure and transparency re. Callinan's 6 2/3% NPI in the HudBay operated 777 Mine. Callinan has had to resort to the Manitoba courts, and significant legal costs, to compel HudBay to "show the books." The financial size and impact of the issue involved may be different but the issues are the same: shareholder interests are at stake within the jurisdiction and the rules and regulations of the regulators: DISCLOSURE AND TRANSPARENCY. Are we to assume that the only time the regulators wake up is when the big boys hammer on the alarm bell and that when the small guys call 'fire', their voices are treated like a malfunctioning smoke alarm?

The Manitoba court has instructed HudBay to "show the books". Where is the voice of the OSC?
