Quite simply, he can't. He would have to exhaust every opportunity Crystallex has and come up with the one that yields the highest value and put it to the shareholder for a vote, before he did anything. He has to protect himself and the Crystallex executive against lawsuits for acting out of the best interest of the shareholders. He can't just do whatever he pleases like some have the false impression he can.
