What we know for a fact is that the court approved the DIP loans i.e. this court says they are legal. What happens in the appellate court is anyone's guess but if Gowling win it will definitely go to the Supreme Court of Canada. I'm not aware of any case quite like this. Foamex, went into Chapter 11 in the US and CCAA in Canada and the DIP lender made a 650% windfall gain but shareholders thought nothing of it (they made a sizeable profit too, compared to shareprice pre-CCAA - what was our shareprice just before CCAA?).
