With a share price this low, if I wanted this mine outright, I'd make a bid now...while at the same time bringing their "poison pill" under the heaviest possible legal attack. If that poison pill got knocked out or held invalid for some reason....this company coluld be got for way below ultimate value.

That game might just be worth the risk....and I bet others more daring than I may just be thinking the same way....
