Privately owned Railway is not a 'common carrier'?

From a post on the FNC board on this site, referring to ArcelorMittal's Railway in Quebec- is this how the law works in relation to RRs in Ontario also?

"The railway is privately owned and, since it does not cross provincial boundaries, it is not deemed a “common carrier” and is under no obligation to offer services to outside parties. Considering ArcelorMittal’s current production capacity of 14 Mt----"

Now, if this is actually the legal position with regard to privately owned railways in Ontario, Then CC (ie KWG) is in a very strong bargaining position.

I thought the railway would automatically be a 'common carrier' Hmmm--
