If my memory serves me right, a lot of the JV partners CEO's knew Richard Nemis for many years, and some even worked with him on particular projects in the past . Richard Nemis personally added some sort of verbally backup plan to the JV's contract - he promised that in case results were bad JV partners could swap claims. I guess that promise doesn't stand anymore.
