You have to understand the rules of the game (and it is a game). Mac is involved in an exclusive negotiation with this 3rd party. The 'exclusive' part means he can't be negotiating with anyone else during this time. Therefore he did not negotiate an agreement with NOT to move the closing date to Dec 01. Mac may have suggested it, and NOT may have decided to do it, but it was not because of any agreement.

Clear as mud.
