WebTech Wireless Announces Developments in Patent Lawsuit

VANCOUVER, BRITISH COLUMBIA--(Marketwire - June 26, 2009) - WebTech Wireless Inc. (TSX:WEW), a leading provider of location-based and telematics services, today announced that it has learned that the United States Patent and Trademark Office (PTO) has stated its intent to allow the LunarEye Inc. (LunarEye) patent after a re-examination of one of its originally-issued claims. This patent claim is the subject of a patent infringement lawsuit launched against WebTech Wireless by LunarEye.

The PTO provided notice of its intent to issue a re-examination certificate after consideration of the patents and printed publications submitted for consideration by WebTech. The PTO previously agreed to review LunarEye's patent at WebTech Wireless' request and in an office action in mid-2008, rejected the patent claim asserted in the lawsuit. In response, LunarEye commented on the scope of one of the claim limitations. This formed the basis, in part, of the PTO's allowance of the originally-issued claim that was subject to the re-examination. The lawsuit in which LunarEye alleges that WebTech's products infringe this patent claim was suspended pending completion of the re-examination, and it is now expected that the lawsuit will resume.

Cameron Fraser, CTO of WebTech Wireless commented, "We asked the PTO to reject LunarEye's asserted patent claim on the basis that this claim was so broad that it was invalid because it was covered by prior art patents and printed publications. It appears that LunarEye has narrowed the scope of this claim."

The PTO decision did not address WebTech's non-infringement and additional invalidity positions which remain.

"The decision by the PTO is part of the process that could ultimately take us to trial. That said, we continue to believe that we will prevail in this matter," said Scott Edmonds, WebTech Wireless' CFO. Adding, "Patent lawsuits are a reality of doing business in the high tech industry and as a leader in the telematics space WebTech Wireless is not immune to such things. We do not expect this matter to interfere with our business plans or significantly impact our results.
