Over three years in the making. Mr Fang has been eating, sleeping and breathing the China deal. And yet certain individuals are under an illusion that a company can just walk in and snag a major deal like this, and to boot, think it's going to be worth $170 million over night. No proven installs, already working on the next generation when the first one never went to market, limited cash(spent years and $5-6 million on developing the first unit, where's the money and time coming for the next generation?), no operational STCs that I can find, etc etc. In Feb '08 the ADCC made a special web cast for AMS shareholders verifying their commitment to this program, so people, getting all excited might be premature.
But my favorite remains the reasons stated in the counterclaim, particularly; interference with legally binding contracts. I wonder how the courts would take this latest ADCC contact into consideration? If only there was a picture taken in front of the ADCC. Keep those positive vibes going, kumbaya all, kumbaya. AeroMechanical Announces Key Contract in China
Calgary / Beijing September 6, 2005 – AeroMechanical Services Ltd (“AMS” or the “Corporation”) and the Aviation Data Communication Company (ADCC), the organization responsible for air traffic communications in China, are pleased to announce that an agreement has been reached and contracts signed whereby AMS will be the only approved provider of Iridium Satellite Communications using AFIRS Global Voice and data communication services for ADCC, who in turn will provide services to all airlines operating in China. This agreement is a milestone for AMS in that it allows for AMS to provide its services to ADCC who in turn will provide services to all Chinese airlines.

Mr Niu Yi, President of ADCC stated “The agreement with AMS solves a lot of problems for ADCC and the Airlines of China. Those include the need for global voice coverage from aircraft to the various organizations on the ground with whom they need to coordinate. As well, the additional services that the AMS product line adds with Data communications and Flight following allows for the standardization of data across a rapidly growing fleet of aircraft. The contract enables China airlines to operate fully in compliance with China Civil Aviation
Regulation (CCAR) 121.”
Mr. Tong Guo Zhao, The vice president of China Eastern Airlines stated that “China Eastern Airlines will be the first airline to utilize this new technology to enhance our flight operations worldwide. This will complement our already impeccable safety record, and assist in our continuous improvement of customer service.” AMS expects the first deliveries under this contract to be made in late September of 2005, with full deployment to
all carriers over the next 4 years. The China Eastern fleet consists of 183 aircraft currently and the entire Chinese fleet is in excess of 900 aircraft.

CALGARY, ALBERTA – AeroMechanical Services Ltd. (“AMS or the Corporation”) announced today that it has filed a Statement of Defence against the Counterclaim brought against it by Star Navigation (SNA on TSX-V), Viraf Kapadia and Peter Verbeek. We will be seeking security for costs from the Ontario Superior Court of Justice as we see the Counterclaim as being frivolous and vexatious.
AMS has counterclaimed against Star. We are claiming damages of $15,000,000 for interference with legally binding contracts of AMS, disruption of business, an attack on our reputation and costs on a substantial indemnity scale. As an owner of the patent which is the center of the controversy and probable benefactor of any outcome, we have
also named Viraf Kapadia as a defendant in our Counterclaim.
In the US infringement case, Star is alleging that AMS is infringing Star’s 852 patent.
Although the case is in its early stages, AMS’ position is that the case is without basis and that there is no merit to the infringement allegations. AMS will defend the litigation vigorously and is prepared to see it to a conclusion. AMS is prepared to take any legal action against Star as is necessary to defend itself and its products.
AMS is a technology leader in airliner performance monitoring systems, and has been rewarded with patents to cover its technology. AMS takes intellectual property matters very seriously and respects the intellectual property of third parties. AMS is disappointed that Star has chosen to attempt to compete with AMS via press release, baseless litigation, and U.S. Patent Office procedure – rather than in the marketplace via better
products and services.
