I think DM will participate in any settlement arrangement.

I don't see any reason why a company would settle without a filing. No logic to that.

If you were in charge, wouldn't you wait for the Markman ruling before giving away your money, they all know the status of the infringement process and we may not win all the marbles. Each casse will be different and we may lose on some of the issues.

I can't see any settlement before the Markman ruling assuming it goes that far. There may be new filings, but probably no settlements.

It hasn't been proven beyond a doubt that are patents are validated. We have a long way to go.
