PLEASE TAKE NOTICE THAT on November 17, 2014 at 10:30 a.m., or as
soon as the matter may be heard, before the Honorable Marilyn L. Huff at the
United States District Court for the Southern District of California, Courtroom 15A,
333 West Broadway, San Diego, California, Defendant Intel Corporation (“Intel”),
will, and hereby does, move to stay this litigation while the United States Patent &
Trademark Office considers Intel’s petitions for
inter partes review and reviews the
asserted claim for invalidity with respect to the patent-in-suit, U.S. Patent No.
5,839,108.
This motion is based upon this Notice of Motion; the supporting
Memorandum of Points and Authorities; the supporting declaration of Christopher
M. Gerson and exhibits attached thereto; all pleadings and papers filed in this
action; and such other arguments and evidence as may properly come before this
Court.
