Reading the link of Wasntime, it appears to me that Intel is trying to take the case out of the courtroom for the moment and change the venue for arguing their case. This would at least delay the matter, as a dissatisfied party to a result argued before the PTAB can appeal in District Court. I have not seen any of Intel's evidence of prior art that might argue that Intel was first to develop and use the intellectual property protected by the 108 patent. When I read EDIG's patents in 1999, I did not see any other company that could claim prior development of the technology.
