UNITED STATES DISTRICT COURT
SOUTHERN DISTRICT OF CALIFORNIA
E.DIGITAL CORPORATION,
Plaintiff,
CASE NO. 13-cv-2905-H-BLM
ORDER:
(1) CONTINUING ALL
DEADLINES UNTIL
NOVEMBER 17, 2014
(2) VACATING THE
NOVEMBER 17, 2014
HEARING ON THE MOTION
TO STAY
(3) APPOINTING BRETON A.
BOCCHIERI AS THE NEW
DISCOVERY LIAISON
[Doc. No. 43]
vs.
INTEL CORPORATION,
Defendant.
On December 5, 2013, Plaintiff e.Digital Corporation filed its complaint against
Defendant Intel Corporation. (Doc. No. 1.) On October 24, 2014, the parties filed a
notice of settlement and joint motion to continue all deadlines until November 17, 2014
pending settlement. (Doc. No. 43 at 2.) The Court orders a limited continuance of
deadlines in this action for the parties to effect settlement. Exercising its discretion,
the Court continues all deadlines until
November 17, 2014.
The Court vacates the November 17, 2014 hearing regarding Defendant’s motion
to stay pending inter partes review. (Doc. No. 40.) Accordingly, Plaintiff does not
- 1 -
need to file an opposition to this motion until a new hearing date is scheduled. See
Civ. L.R. 7.1(e)(2).
The Court appoints Breton A. Bocchieri, counsel for Kingston Technology
Company, Inc., as the discovery liaison for this subset of consolidated cases.
The remaining cases in this subset of the consolidated cases are 13-cv-2906-H
(BLM); 13-cv-2930-H (BLM); and 13-cv-2943-H (BLM). The notice of settlement
and this order do not impact any deadlines for the remaining cases in this group. This
case remains the current low number case for this subset of the consolidated cases until
it is dismissed by the Court. If the Court dismisses the case, the next low number case
will be 13-cv-2906-H (BLM).
IT IS SO ORDERED.
DATED: October 24, 2014
