e.Digital Receives Favorable Claim Construction Ruling

December 15, 2014: 04:51 PM ET

e.Digital Corporation (OTCQB: EDIG), a long standing source of innovation and future-defining patented technologies, announced today that the United States District Court for the Southern District of California ruled in favor of e.Digital on all points addressed in a claim construction hearing of the Company's US Patent No. 5,839,108 ("the '108 patent") held on December 12, 2014.

A claim construction hearing, also known as a Markman hearing, allows each party to advance their own meaning of disputed claim terms, which the Court analyzes and issues an order setting forth the meaning of those terms. The '108 patent, which relates to the way modern day flash memory devices store and manage data, is part of e.Digital's Flash-R™ patent portfolio. The Company's law firm, Handal & Associates, advanced a total of 12 disputed claim terms together with their constructions, and challenged the asserted claim constructions of the Defendants. The Court ruled in e.Digital's favor on all contested claim terms.

"This entire process has vindicated our efforts to stop infringement of the Company's patents," said Fred Falk, president and CEO of e.Digital. "e.Digital is the owner of key intellectual properties in the security space and as we look to the future with these new technologies we believe that this and other recent favorable rulings will give pause to those who might choose to use our ground breaking technologies without our approval," concluded Falk.
