In these related cases, Plaintiff e.Digital asserts that each of Defendants has infringed one or more of the following United States Patents: 8,306,514; 8,311,522; 8,311,523; 8,311,524; 8,315,619; 9,002,331; 9,178,983. Attached to this order as Exhibit A is a chart showing the in which cases each patent is asserted and the dates on which technology tutorials and claim construction hearings have been set.

 

 

The data on the attached chart strongly suggest that these cases should be managed jointly. Plaintiff asserts four of the same patents in three different cases, and three of the same patents in one additional case.

The Court has not decided how to adjudicate these cases efficiently. Perhaps the Court should consolidate them for pretrial discovery, pretrial conference, and/or trial, or construe common patents in joint claim construction hearings. Perhaps the Court should take additional or different steps. What is clear, however, is that allowing the cases to proceed separately, and conducting separate claim construction hearings on each of these cases seriatim, would lead to the needless expenditure of the parties’ resources and the Court’s time.

 

 

 

Accordingly, the parties in each of these cases are required to file a single Joint Case Management Statement collectively by February 17, 2017 at 5:00 p.m. The statement will make a joint proposal or competing proposals for the management of the cases. The Court will either choose one of the parties’ proposed case management structures or adopt its own. In either event, the Court’s goal will be to maximize the value of the information received by the Court and the parties about each of the patents at issue, relative to the time and resources needed to acquire that information.

 

The Court sets a Case Management Conference in each of these cases on February 23, 2017 at 9:30 a.m.

 

The claim construction hearing currently set for February 28, 2017 in Case Number 15-cv- 5793 is VACATED. All other dates in that case remain as previously set. The dates previously set for hearings in the remaining cases remain available for use in the joint management of these cases. The parties should anticipate that the Court will make additional scheduling orders on February 23, 2017.
