ads, RE: court date

posted on Dec 13, 04 08:41AM
Thanks for your post. Just to be sure everyone is clear, this ``court date`` is only a ``case management conference``, i.e., not a trial or even a hearing.

A CMC is usually designed only to let the court know the status of the case, such as whether there are any problems with discovery or other such matters. Trial dates can be discussed, but usually only in very general time frames, and usually at least several months out. In other words, the likelihood of any substantive developments coming out of the CMC is highly unlikely, although as I have said before, the judge or magistrate could possibly use it as an opportunity to make some vague comments that arguably help one side or the other.

Almost certainly, the chance that PTSC would come out with a PR that comments on this conference (except, as above, perhaps to talk about a time frame for a trial date) is virtually zero. I can`t think of too many things that would anger a federal judge more than to be quoted outside a formal ruling for the purpose of gaining some type of leverage in the stock market or in public opinion. So if anyone here is looking for ``news`` based upon the substance of this CMC, don`t hold your breath.

Good luck to all.
