No, it won`t. One thing most federal judges won`t stand for is unnecessary delay --- they don`t like their dockets cluttered with cases that have been around for years.

As moxa has posted, B & O has indicated the likelihood of a trial setting in April 2005, and that`s probably about right. Remember, the CMC on 12/17 is a ``further`` conference, indicating that there has already been at least one --- as I have said before, the upcoming CMC is likely only for the purpose of talking about what was unresolved from the last time the parties met with the court. As such, I would be surprised if we don`t soon hear about a trial setting --- it may not be April, but I would be surprised if it`s too far after that.

As always, of course, we shall see.
