It is my understanding (please correct me if I'm wrong) that they can base it on the previous version because technically the certificate has not been issued yet (only the "Intent" has). If the certificate had been issued they could only base it on the "new" '336 and therefore it would have been denied. They got it in just before the bell as a delay tactic IMHO.
