As I posted earlier this week, the court date on Friday, based on what I have seen from other posts here, is merely a ``case management conference``. I haven`t gone to the court`s website to confirm that, but to my knowledge, there are no motions set for decision.
While it is always possible that the judge or magistrate could make some comments, even strong ones, favoring one side or the other, that would be unlikely. A CMC, as the name specifies, is for ``management`` of the case toward trial, not for substantive decisions on the core issues. And even if ``decisive`` comments should be made, any party that puts out a PR based on such would probably be subject to sanctions by the court. It is one thing to say something to the effect of, ``We are encouraged by what took place at the recent CMC``, but quite another to state, ``Based upon comments made at the CMC, the judge has indicated that he will find in favor of our position``.
I am outlining this again because I wouldn`t want anyone to go out and load up on on shares thinking that there is likely to be some type of major spike in the price on Friday or Monday. Anything is possible, but that kind of development, based on a mere CMC, is highly unlikely IMO.
