It's worrisome because TPL appears to have claimed chip x infringed and then referenced chip y to support its claims. It's worrisome because if they had the proof that chip x infringed they would have submitted it. It's worrisome because it really doesn't matter how the judge rules on claim constructions via the markman if tpl can't prove infringement. This was extremely poor research by TPL/Alliacense and they got called out for it.
