The decision to dismiss without prejudice was based on AMS’s representations during discovery that the cost of the litigation would be significantly greater than any damages Star would receive, based on the limited number of sales AMS has made since its formation. According to AMS itself, any damages that Star could possibly obtain in the litigation are far outweighed by the legal costs already incurred by the parties.

Hmmmmm, if SNA drops their case in California and AMA drops theirs for similar reasons in Ontario, does that mean that SNA and AMA could become friends. Perhaps we could all get together have a beer and sing Kumbaya LOL.
