This is just my opinion but maybe there are more than one strain of H1N1 going around and without going into further detail, the company can not claim that it kills H1N1 and if there is a mutation, the company will have to change all the older bottles that claim it kills H1N1 when in fact the company only tested one strain.

Second opinion maybe the testing has to be done by the government to make that claim as oppose to independent labs.
