I think we will lose this appeal. No doubt this dividend was orchestrated by VZ will the sole aim of avoiding execution of ICSID awards but it appears that Delaware courts don't have the statutes to cover this. I guess that's why so many companies incorporate in Delaware and why Delaware makes so much money from these companies.

Difficult to understand why they didn't do this before the GRZ rulings - perhaps the US lawyers hadn't thought of this at the time.
