Message: VENEZUELA'S REPLY TO KRY OPPOSITION - SCOTUS

The next steps:

a. SCOTUS decides whether or not to ask the Solicitor General (SG) to intervene regarding the foreign relations argument raised by Venezuela. There is ususally no deadline set for the SG to issue his brief upon the request of the SCOTUS.

b. Once the SG brief is in (if requested), the SCOTUS sets a date for the oral arguments, which would not take place before January 2021, with a final ruling issued by the end of the 2021 term (June 2021). If the SG is asked to intervene, the whole thing then moves to 2021, since the SG will most likely not rush to issue his brief before the end of the SCOTUS term, which goes from October through June.

c. If the SCOTUS decides the case can and should be resolved on the legal merits only, its decision to grant Certiorari or not will be done by the end of the current term (June). 

  1. If Cert is granted, the oral argument and final ruling will take place by June 2021.

  2. If Cert is denied, the case is  sent back to the Delaware District Court (DEDC) for execution. The process and timing for the auction will be determined by the DEDC, once KRY obtains de OFAC License. If the SG does not get  to issue a brief sua sponte or by request from the SCOTUS, OFAC will be required to issue the license.  

d. The SCOTUS may also decide to request additional briefs before deciding on the Cert request, or send the case back to the Philadelphia Court of Appeals for further legal review.

Whatever the scenario, this case will not be resolved before 2021.
