I have held my KRY in an active account and there has never been any issue.

As far as declaring a tax loss, my adviser advised, and I have done that years ago to offset a gain in another investment.  When (if) my KRY share are eventually sold, it will be against a zero dollar average cost base. I don't expect any issues.
