In what may be the most important patent case in the last 20 years, The Supreme Court recently sided with The Federal Circuit’s critics who claimed The Circuit’s interpretation of what should be patentable was too liberal. In KSR vs. Teleflex, The Court ruled in favor of KSR, who argued successfully that Teleflex’s patent for its adjustable accelerator pedal was invalid due to obviousness.

The Court’s handling of obviousness and prior art in this landmark case has made obtaining and defending patents more difficult. The Court of Appeals for the Federal Circuit and the PTO have now started to flesh out the implications of the KSR decision. What does this decision mean to the IP community? How can patents withstand the obviousness challenge in this new era?
