• lawmakers in New York have gone all-in legalizing the recreational use of marijuana by adults. On March 31, 2021, New York Governor Andrew Cuomo signed into law the New York State Cannabis/Marijuana Regulation & Taxation Act, reducing barriers to employment for users and encouraging employers to rethink their positions on marijuana.
• Finally, employers will need to carefully develop and implement policies to assess a reasonable suspicion of impairment at the workplace or while on duty to defend an adverse action taken due to a positive test for marijuana
• Employers may prohibit and take adverse action due to an employee’s workplace “impairment.” The Act states that an employee is “impaired” by cannabis use when the “employee manifests specific articulable symptoms while working that decrease or lessen the employee’s performance of the duties or tasks of the employee’s job position, or such specific articulable symptoms interfere with an employer’s obligations to provide a safe and healthy work place, free from recognized hazards, as required by state and federal occupational safety and health law[.]”
• I think the better option, and what employers will very likely do instead, is look at whether the employee is impaired, specifically in the workplace," Shoikhetbrod said. 
• Kerbein said cannabis differs from alcohol because there isn’t a way to test to see how much of it is in your system. “We all understand breathalyzers and .08 and what alcohol does and those levels of impairment. We don’t necessarily have that technology yet. There’s not a breathalyzer for these THC impairment-inducing components of cannabis.”
