Led: Unless Resverlogix has claimed Friedreich's ataxia in any of their patents, I cannot see how Resverlogix would be able to challenge the patent application (on grounds of infringement). I don't know what the author of the article meant with her comment, but it is a fact that you cannot prevent others from building on your inventions and claim those improvements as their patentable contribution - but that does not change the fact that if you want to market your contribution/improvement, you need to respect other peoples patents and get the right licenses.
