The SEC could treble it's staff and use it exclusively for prosecuting counterfeit shares. Unfortunately, they wouldn't scratch the surface. These criminals are willing to take the chance because they know the chances of their being investigated and prosecuted are slim to none. Them's pretty good odds. There should also be a means devised to pierce the corporate veil and land squarely on the individuals as well. Not only should they be criminally prosecuted but their personal assets should be placed in jeopardy. I also think this activity should not be described as naked shorting. If you short and cover timely, there's no harm. The moment you go significantly beyond the allotted time, it's counterfeiting......pure and simple. We should call it that. "Joe Average" probably thinks naked shorting has something to do with unclothed midgets but even he knows what counterfeiting means.
