On March 19, 2014, Plaintiff e.Digital Corporation filed its First Amended
Complaint (“FAC”) against Defendant Intel Corporation. (Doc. No. 13.) On March
28, 2014, Defendant filed a motion to dismiss Plaintiff’s FAC. (Doc. No. 18.) Plaintiff
filed its opposition on April 14, 2014. (Doc. No. 22.) Defendant filed its reply on
April 21, 2014. (Doc. No. 23.) A hearing on Defendant’s motion is currently
scheduled for April 28, 2014 at 10:30 a.m.
The Court, pursuant to its discretion under Local Civil Rule 7.1(d)(1), concludes
that resolution of the motion does not require oral argument. The Court therefore
vacates the scheduled hearing and submits the motion on the parties’ papers
