With that if, hypothetically, the PTAB rules positive to e.Digital, IMVHO, it kills the exhibited Prior art NEW. If that had happen what would MSFT/ Dartmouth College have argued about that? As they would not have had the opportunity to defend their own IP....

They might not have cared if their respective IP was dead, however when NEW ?
