Message: TSX Company Manual and Delisting

KRY will not be halted and immediately delisted on Dec 5.

From the TSX Company Manual, a TSX delisting is actually done 30 days after the issuance of any such notice. Any halt on Dec 5 would be to disseminate information, in this case the notice to delist. The 30 days gives the Company the opportunity to stand up for shareholders.

Again, the TSX Company Manual shows that a listed issuer can contest a decision under Part VII by requesting that the matter be heard by the committee originally making the decision, as well as include the Senior Voice President and/or his/her designate.

If still dissatisfied, the listed issuer may appeal to a three-person panel of TSX Board.

The two opportunities for the Company to fight for shareholders may, or may not, give six additional months of TSX listing as it did with NYSE/AMEX. But, it will take some time if the Company chooses to fight for shareholders.

Regardless, KRY will not be halted and immediately delisted Dec 5.

The soonest the Company will be delisted and halted from trading on the TSX is 30 days after the notice. This would happen only if the Company does nothing in response to the notice to delist.
