Not a big deal, it's boiler plate that is saying nothing in life is certain, which we all know.

1) while possible that we could lose the arbitration on jurisdiction or the merits, IMO the chances are smaller than flipping heads 30 times in a row on a coin.

2) Venezuela can refuse to pay and get away with it if they stop selling oil, half of which comes to the US Gulf Coast, and there is zero chance that will change in the next 5 years until somebody else builds heavy crude refining capacity. That is why they always pay no matter how much Hugo whined.

3) the Panel cannot award Crystallex an order to resume the project, they can only award money, so that is a silly statement. If it were otherwise, that would impinge on Venezuelan sovereignty as a matter of international law.

The only real warning that they should state is, "we may run out of money due to inadequate planning, and might not be able to get more."
