EZ- Get your head out of 2011 and get into the current discussion on the board. GRZ is ahead of us because they filed earlier and already have WON their arbitration, this is fact. What contract, consession or agreement they had does not matter now. The Vennies have 60 days to respond to the US court ruling saying they must pay, and the Vennies will have 60 days when the same US courts hear our case for non-payment which is exactly what is going to happen eventually (if we get an award). The merits of the induvidual cases and how many times you post on the merits is what's irrelevant, nobody is talking about the merits anymore. Everyone here, Imo, should be past that point now. The general question left is how big is the award going to be? The only real questions after that are: How much is (not when is) Kry going to be paid and how much is going to be left for the shareholders. (Seems as though the answer to how much the GRZ shareholders get is a much brighter prospect than ours right now, don't you think?) The Venezuelan Government could regieme change before we get a decision or a payment, and that might change the endgame as compared to GRZ's, but at least we get to see what happens right now with GRZ- in 60 days. Non payment of the ICSID award?: Venezuela is surely to repeat this strategy with Kry, that is almost a certinty. GRZ is still about a 1/2 year ahead of our case. Hopefully they get paid or stuff is siezed from Venezuela at the end of the 60 days. There is a difference between my opinion and yours and if one or both are assnine, well I will just leave that up to the boardmembers.
