The quote is from the factum. g4gold is quoting Gowling and not referring to his position in KRY.

Given that I/we have no way of knowing if g4gold is a shareholder or not and whether he/she is an opt in or not.

Either way I appreciate pointing out the statement so everyone here can see what Gowling said to the judge about Tenor/Kry comments about the committee and opt ins.
