Of course there is recourse against injustice. As to "fair", that's in the eye of the beholder. The noteholders don't think this is fair, they are the injured party, through no fault of theirs. Shareholders caused the company to go into CCAA, fair for shareholders is losing everything, that's what usually happens.

If you believe what you write then seek out a lawyer.
