Twilight, how can the gold belong to the holdout?

If you buy a mineral interest in property. the minerals below a certain depth, say 3 metres, belongs to you, not the owner of the surface rights. With your mineral interest, you have the right to use a much of the surface as is reasonably necessary to access your minerals. In the case of an open pit mine, I think it can be considered reasonable to require the entire surface area of the pit.

Yes, by obstructing the legal process, the surface rights holder can make it tough for you and make it expedient for you to bribe him to desist rather than go through an arduous and unpopular court process.

So, are you a renegade? Or do you support due legal process as being preferable to anarchy?
