Message: Idle Speculation?

If I were Big Pharma looking to acquire a small company with a blockbuster drug, and willing to put up a sizable chunk of change to see AFRESSA through to approval, would I rather wait until all legal and class action suits were settled? Or would I prefer to acquire the company and pick up their tab for their legal fight?

If I were Mannkind on the other hand, would I prefer to clear all decks of class actions and other legal problems to make the company more attractive? Or would I continue to plod along and hope for the best. Also, would it be better to go into the marketplace with a blockbuster drug free of legal hinderances that might cause a further delay? Or clean up the obstacles beforehand?

In the scheme of things, 16M and 2.8m in stock, seems to be a small price to pay in order to move forward.

It might be a simple way to look at this but often times, the simple answer is the best.
