It is my understanding that the ruling can not be appealed until the case is over. Having said that one or two things will have to happen either we go trial or the defendants win on SJ. Reading the ruling, I think she will grant SJ and then DM can appeal if they so choose.

Nice to see the volumn but not the price. I am suprised that neither Edig or DM has responded to this ruling prior to the market opening.
