Dischino, as for the header, retail defendant count is going to be hard to count now as certain ones are being motioned for dismissal / stay...form cases before the cases are settled.

That may be a good sign, they just want out prior to the formalities of the tech defendants settlement....Dismissed without prejudice seems to let them out early, at least that is how I see BestBuy.com being dismissed form the Iriver issue and Creative case.

Newegg is being dismissed form the MiTac case....

anyway, little bits and pieces like that give a hint of what progress might be happening..
