Message: Re: Pacer-Arcsoft(Fish&R... refuse the case transfered to Northern district

"Further, Plaintiff’s reliance on the Local Rule seeks to circumvent Plaintiff’s burden of proof required to establish that venue is proper in the transferee district and convenient for the parties. Plaintiff chose to bring the present case against ArcSoft in the Southern District. In fact, Plaintiff also initially chose to bring the case against Dropcam, Inc. in the Southern District and the case was transferred only after Defendant Dropcam, Inc. filed a motion to transfer which Plaintiff opposed. In the present case, Defendant ArcSoft does not intend to move to transfer,does not believe venue in the Northern District of California is proper or convenient, and will oppose Plaintiff’s motion to transfer."

NUNCHI cases....

e.Digital Corporation v. ShenZhen Gospell Smarthome Electronic Co., Ltd. et al NUNCHI NORTHERN

e.Digital Corporation v. ArcSoft, Inc. NUNCHI...SOUTHERN

e.Digital Corporation v. Dropcam, Inc. NUNCHI...NORTHERN

Handal filed, initially, in SOUTHERN DISTRICT for Dropcam and ArcSoft, Inc.(NUNCHI matters) @ the same time, (a detail defendant ArcSoft forgot to mention in its recent brief regarding moving the case) where Dropcam opposed the venue and had the case moved to Northern.

Seeing the NORTHERN now being the prominent venue, as a GOOGLE issue, ShenZhen was filed in Northern. Handal simply would now like to have ArcSoft, consolidated to the NORTHERN.

==========================================================

Judge Huff does sit in the Southern, however, she is presiding over 108 cases. HP now being rescued to yet another judge by judge Huff..for what ever reason.

Judge Sabraw (Southern) is presiding over two remaining 2012 cases SNDK and Woodman(GoPro)...now considered for 108 issues. SNDK and e.Digital recently filed a joint case management statement, where e.Digital motioned in the statement to have the case moved to Huff...Sabraw said NO.
