Yes, but the noteholders already fought their case and one of their points was that KRY should have filed arbitration. Just as the judge said they could not complain about receiving the interest payment they demanded I doubt one would say they had the right to complain about filing when that was what they wanted. I doubt they could file another suit under this circumstance.
