You can ignore hoov, that's your choice. But he is listing the requirements to start digging the pit, and pointing out that ZEN has not announced that they have met, or even started, any of them. Your rebuttals are, in effect, that the government will overlook them because ZEN is so special.

Think about the precedent that would create. The government can ignore its own rules, rules that apply universally to any company intending to mine. What criteria would then be used in determining who is special? How do you justify one company going to the trouble and expense of meeting the requirements, while another gets a pass? The answer, of course, is you can't. Rules are in place for everyone, there can be no exceptions.

So if you choose to ignore hoov, that's fine. But remember what he is telling you, and maybe give a thought or two to how ZEN can meet the necessary conditions and still start mining in 2+ years.
