Ted...We got a good court opinion for NUNCHI 522 right out of the gate...only to face IPR with a stay.....where the IPR ended unresolved when the court case settled.

Between the court and the PTAB there were no real conclusions as to validity.

This stand off between two very different authorities is now the problem....for me anyway.

Can't blame the court, can't blame the PTAB

No discernable factors between the two leading to a settlement.

Was it the strength of the courts claims construction conclusions... moved to sitting idle on a stay pending IPR decision? Or was it that the two parties could not stand the wait for an IPR decision?

One of the two flinched...that's for sure.

Google could have waited out the IPR decision...why did they not do so, after all, the court case was just sitting idle?

We are now totally in the dark with these new procedures.
