I don't want to go to far with this but my concern is that the MOC explicitely acknowledges the possibility that an environmental permit may be denied. VZ never promised or guaranteed an environmental permit. Countries around the globe routinely grant or deny permits sometimes offering no reason at all for their decisions. Does not issuing the permit actually constitute abrogation given that it is an outcome that was forseen as a possibility in the MOC itself?

I'm not so sure.

This point can only be argued if VZ doesn't plan to mine LC because of environmental concerns. They wouldn't have a leg to stand on denying Kry and the giving the permit to anyone else to mine LC especially when Kry has met all the conditions need to receive the permit.

I have no concerns about this part of the MOC because we all know that LC will be mined. Hugo and Sanz have both said they want LC mined so denying the permit because of environmental concerns doesn't work.
