Lots to think about, for me anyway.

I would say the same is true for the new firm.

They would need a positive out come from the repeal process.

They are gambling it's favorable. Claim 5 in marking bad cells of memory is the bases of the operating system and how it functions.

The gamble....we get a positive result, or, new verbiage added to the 737 patent.

It's clear e.Digital did not want the new verbiage added in order to keep the current legal prospectives in play.

If new verbiage is added they would have to move on to other targeted issues.
