"What is there to appeal if nothing has been sent out?"

That was my reaction when I saw the notice of appeal. The last I heard, Claim 5 was still an issue, with the re-examiner continuing to reject it as written, and EDIG pushing ahead with it anyhow (at least that's how I understood it), so maybe this appeal is part of that process?
