The last action by the USPTO was reexam certificate of service on Aug 30, same day EDIG filed an appeal, and it's acknowledge received/posted Sept 5.
No rejectioin to our response has happened since we filed July 30.
All I see are "procedural" steps.
If I am not mistaken from some stuff sman has posted about timelines, there is a procedural step to file an appeal as well, should the USPTO not respond in a specific timeline.
In other words, looks to me to be a CYA and nothing more.
If my guess is right, NIRC "I expect soon."
