1- They didn't have any question about the RFP while other companies had tens of 
  questions.

Because they already knew the answers?!

2- Poet is not ready yet. They don't even have their prototypes (yet) which  would prove  the functionality of Poet's  technology.

They have prototypes of the detector, the VCSEL, thyristors (well, only with 3 terminals) - and quite sure some significant proof points for all their patents. Missing is the combination to an optical engine, and this they plan to develope in this project!

3- They still need to obtain many other patents, before they formally can claim they are 
    the owner of the  technology .

Please have a look at their 53 patents and tell us which do you miss? Who would be the owner of this technology but POET?
